PRIVACY POLICY

 

Fiducia Score Private Limited having its office at R-5, A/2, Imayam Colony, 2nd Street, Anna Nagar, West Extn, Chennai – 600 101 (hereinafter referred to as “Fiducia”, “We”, “Us” or “Our”), on behalf of itself and its affiliates/group companies under the brand ‘Trstscore’, operates the Platform https://trstscore.com (together referred to as “Platform”). 

This Privacy Policy (hereinafter referred to as “Policy”), helps the registered users of the Platform accessing the Platform (“User”/ “You”/ “Your”) and availing the Services therein to understand the type of information collected, the purpose for which the information is collected; how the information is used; the intended recipients of such information; and how the information is protected. We take protection and proper use of Your information seriously and are committed to protecting such information in Our possession. We advise You to read this Policy carefully prior to Your access of Platform, use of Services, or creation of an Account on the Platform. If You do not agree to this Policy, please do not access Our Platform, use Our Services, or create an Account in Our Platform. 

If We learn that We have collected the Personal Information (defined below) from a User who is under the age of 18 that was not provided under the supervision and consent of the minor’s parents or guardians, We will promptly delete such information. If You believe that We have collected Personal Information from someone under the age of 18, please contact us at [•]. 

This Policy is published and shall be construed to be in accordance with the provisions of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data of Information) Rules, 2011 and Information Technology (Intermediaries Guidelines And Digital Media Ethics Code) Rules, 2021 under the Information Technology Act, 2000 and other applicable laws that require publishing of the privacy notice for collection, usage, storage, disclosure and transfer of sensitive personal data or information.

Any capitalized terms used herein without definition shall have the meanings assigned to them in Our Terms of Use.

 

INFORMATION COLLECTED BY US 

When You access our Platform and/or choose to avail the Services provided by Us through the Platform, We shall collect certain information from You, the details of which are provided hereinafter. The categories and sources of the Information collected by Us are as follows:

 

  1. Personal Information Any Information that relates to You and Your employees as a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying You and any further information, including, without limitation, provided by You to Us while signing up for availing the Services such as: 

  2. Name, Phone, Email ID, PAN,  Employment Details, Employee ID, Designation etc

  3. Any other identifiers and any other sensitive/personal information as defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data of Information) Rules, 2011 as amended from time to time and such other data privacy laws whether now in force or in future (“Personal Information”).

  4. Location Data: Location is key to securing the application and in order to do certain checks such as GPS based address verification or for attendance should you use our services. We have set restrictions to make sure the application is not accessible from certain locations in the world such as China, certain african countries etc besides tracking locations for security purposes. Hence information about Your location when accessing and/or using the Platform if You chose to opt-in. With Your permission, We may collect Global Positioning System (GPS) data and mobile device location information. If You do not wish to share Your precise location with Us, You can switch off location services via the settings on Your device.

  5. Cookies: Cookies help us track usage of the application besides login information and login times etc. Users are given a choice of cookies they want to allow while using the application. We and Our service providers and business partners (e.g. Google Analytics, Captcha etc) use cookies and other similar technologies (e.g. web beacons, flash cookies, etc.) (“Cookies”) to automatically collect information, measure and analyze which web pages You click on and how You use the Platform, enhance Your experience using the Platform, improve the Platform etc. Cookies enable the Platform to provide certain features and functionality. Cookies used by us will not be used for any other purpose other than for the functional purpose of the application. This is our privacy promise.

  6. Transaction and Payment Information: Although Fiducia Score does NOT STORE and use any payment related information such as credit/debit/UI, address etc. except the success and failure of such payment transactions etc. Our authorised payment gateway solution providers such as Razor Pay and PayU, may collect information such as billing address, credit/debit card number, its expiration date or any other payment instrument details and transaction details or any other third-party payment information of the Users. Users are responsible for reading their terms and conditions. 

  7. Device Information: Fiducia Score collects device information as much as necessary to secure the application such as Device Name, IP, etc. We collect this information purely to secure the application or for signing documents example consent forms and only as much as necessary to do the same. As and when you use our application, there maybe relevant device permissions which maybe sought which is left to the user to accept or deny as per the Web, Google or Apple Store rules. 

  8. Messages: Fiducia Score may send messages on your behalf when using the application for transaction and processing as the user may not recognise Fiducia or our brand names. You provide explicit consent to send such messages on your behalf when using our application. Actions performed in the application may lead to such messages for success/failure and you agree not to block or mark as spam such messages either sent or received. We may read certain messages example OTP sent by us to login to the application automatically or for security purposes to ensure that the application is not in the wrong hands. You agree to receive messages and email which will be sent by us for letting you about a webinar, feature upgrades, or communication related to our company which we deem useful for all our users.

  9. Third party Information : Information about You that We may receive from third parties services will be stored and processed in our application and used only for effective use of the application or render service and you give your consent for the same.

USAGE OF YOUR INFORMATION

Any information that is not Personal Information, but information collected in relation to Your use of the Platform or information required for the proper functioning, analysis and anything that will aid in making the platform better for development of the Platform.

As explained below, We use Your information to improve, support and administer the Platform, to allow You to use its functionalities, and to fulfill and enforce Our Terms of Use. We may also use Your information to, among other things, show You suggestions, promote the Platform.

 

We generally use the information We collect before signing up on the Platform: 

 

  1. To structure the Services provided to the users through the Platform

  2. to fulfill requests for services, Platform functionality, support, and information for internal operations, including troubleshooting, data analysis, testing, research, statistical, and survey purposes;

  3. to communicate with You, including to notify You about changes in Our services;

  4. quality assurance purposes

  5. to improve and develop Our Platform and conduct service development;

  6. to customize the Services, You see when You use the Platform; to enforce Our terms, conditions, and policies;

  7. to prove Your identity in order to use certain features,

  8. to combine all the information, We collect or receive about You for any of the foregoing purposes;

  9. to maintain security and help Us detect abuse, fraud, and illegal activity on the Platform;

  10. to understand how You use the Platform, including across Your devices;

  11. to support the social functions of the Platform;

  12. for any other purposes disclosed to You at the time We collect Your information or pursuant to Your consent.

 

However, If You have given us Your information, We shall use all the data collected to: (i) Contact You for taking Service feedback 

 

We shall not sell Your Personal Information to any third party, for any reason, at any time. 

 

SHARING YOUR INFORMATION

We want You to understand when and with whom We may share the information We collect for business purposes. Your information is shared with others in the following ways:

 

  1. Public Information: Personal Information that You upload to the Platform (such as certain Account profile information), certain other information of You, will automatically, or upon Your selection, be made publicly available to other Users on the Platform. 

  2. Legal Reasons: We may disclose any of the information We collect to respond to summons, court orders, legal process, law enforcement requests, legal claims, or government inquiries, and to protect and defend the rights, interests, safety, and security of Us, the Platform, Our affiliates, Users, or the public. We may also share any of the information We collect to enforce any terms applicable to the Platform, to exercise or defend any legal claims, and comply with any applicable law.

  3. Sale, Merger, or Other Business Transfer:: We shall ensure that the terms and conditions as stipulated here are adhered to even during our sale/merger etc. 

  4. Service Providers, Business Partners:  We share the categories of Personal information listed above with service providers and business partners to help Us perform business operations and for business purposes, including research, payment processing and transaction fulfillment, database maintenance, administering contests and special offers, technology services, deliveries, sending communications,  analytics, measurement, data storage and hosting, disaster recovery, , marketing, and data processing. These service providers and business partners may include:

  5. vendors (example should you show interest in you or you company wanting cancer screening for yourself or for your company, we may share this with vendors who provide such a service example Karkinos), who may receive the information You choose to provide, the information We obtain from other sources, and the information We collect automatically but would not receive Your payment information or message data.

  6. Payment processors and transaction fulfillment providers, who may receive the information You choose to provide, the information We obtain from other sources, and the information We collect automatically but who do not receive Your message data.

  7. Cloud providers, who may receive the information You choose to provide, the information We obtain from other sources, and the information We collect automatically.

  8. Research providers, who may receive the information You choose to provide, the information We obtain from other sources, and the information We collect automatically but would not receive Your payment information or message data.

  9. Customer and technical support providers, who may receive the information You choose to provide, the information We obtain from other sources, and the information We collect automatically.

  10. API Service Providers who may receive the Personal Information you choose to provide and entirely used based on consent given the Personal Information Owner. 

  11. Third Parties: We may share aggregated usage information and may otherwise disclose non-Personal Information that We collect to third parties. However, absent Your prior consent, We will share Your Personal Information with third parties only in the ways that are described in this Policy and terms of service, including as set forth below.

We may use third parties to outsource one or more aspects of Our business and/or Platform operations (such as email e.g. Sendgrid or CRM software functions e.g. Zoho, etc for performing our daily operations as the need arises), in which case, We may provide Your Personal Information to such third parties in connection with the performance of such activities. Such third parties will only use Your Personal Information to the extent necessary to perform their functions and will be contractually bound to process Your Personal Information only on Our behalf and in compliance with Our requests. We sign NDAs with any such third party.

We will also share Your information with any member, subsidiary, parent or affiliate of Our corporate group, to assist in the improvement and optimization of the Platform, in order to prevent illegal uses, increase user numbers, development, engineering and analysis of information or for Our internal business purposes.

  14. In the unlikely event of Our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, We may not be able to control how Your Personal Information is treated, transferred, or used but will do our best to ensure it is not abused.


 

SECURITY

 

  1. We follow generally accepted standards to protect the Personal Information submitted to Us, both during transmission and once We receive it. Since no method of transmission over the Internet, or method of electronic storage, is not 100% secure, therefore, We cannot guarantee its absolute security.   2. We use a combination of firewalls, encryption techniques and authentication procedures, among others, to maintain the security of Your online session and to protect Our online accounts and systems from unauthorized access.

  3. When You register for the Service, We require a password/OTP from You for Your privacy. We transmit information such as Your login credentials for Platform or account credentials securely

  4. Our servers are in secure facilities in AWS where access requires multiple levels of authentication, including an identity card and biometrics recognition procedures. Security personnel monitor the facilities 7 days a week, 24 hours a day.

  5. Our databases are protected  and encrypted. We encrypt Your Service OTP so that Your OTP cannot be recovered, even by Us. All backup drives and tapes also are encrypted.

  6. We enforce reasonable access controls to Our buildings. No employee can put Personal Information on any insecure machine (i.e., nothing can be taken from the database and put on an insecure laptop). We permit only authorized employees who are trained in the proper handling of customer information, to have access to aforesaid Personal Information.

 

STORAGE AND TRANSFER OF INFORMATION

 

  1. Information collected by Us may be stored and processed in India or any other country in which We or Our agents maintain facilities while adhering to any local laws. 

  2. We make no representation or warranty with respect to any duty to permanently store any information You may provide or that We otherwise collect about You except as required by the laws in India.

  3. We strive to keep Our processing activities with respect to Your Personal Information as limited as possible. In the absence of specific retention periods set out in this Policy, Your Personal Information will be retained only for as long as needed and may use it to fulfil the purpose for which We have collected it and, if applicable, as long as required by statutory retention requirements. Typically, this means We retain Your Personal Information for as long as Your Account is active and for up to 180 days following deletion of Your Account. Please note, active and deletion may also involve other third parties such as your employer who may have right to keep it in our systems and hence your data may still reside in our platform even though you as an individual may have deleted your account or may withdraw consent to store or process it. Please note that statutory storage obligations or the need for legal actions that may arise from misconduct within the Platform can lead to a longer retention of Your Personal Information. By using the Platform and providing Us with information (including Personal Information), You waive any claims that may arise under Your own or any other local or national laws, rules or regulations or international treaties. We may from time-to-time transfer or merge Your information collected off-line to Our online databases or store off-line information in an electronic format. This Policy applies to Your information for as long as Your information is in Our possession, even if You terminate or discontinue Your use of the Platform.

In the event that We undergo re-organization, are sold to, or merged with a third party, or sell all or substantially all of Our assets, any Personal Information We hold about You may be transferred to that re-organized entity or third party in compliance with applicable law and this privacy statement.

INTIMATION BY YOU REGARDING CHANGE IN PERSONAL INFORMATION

If Your Personal Information provided to Us when You had registered yourself in Our Platform changes, You must update it as soon as possible. To review and update Your Personal Information by sending an email to [support@trstscore.com].

 

Note: We will retain Your information for as long as Your account is active or as needed to provide You Services. If You wish to cancel Your account or request that We no longer use Your information to provide You Services, You can delete the Account through the “Delete” option in our Platform. However, We will retain and Use Your information as necessary to comply with Our legal obligations, resolve disputes, and to enforce Our agreements.

 

  1. EMAIL NOTIFICATIONS AND OPT-OUT : We maintain a strict “no-spam” policy. Unless You requested otherwise in Your account settings at the time of Your initial registration or specifically opt out as provided herein, by accepting the Terms of Use and this Policy, You expressly agree that We may use Your information to contact You by email in order to deliver You information that is relevant to Your use of the Platform such as administrative notices, product/service enhancements or “newsletters”, or that, in some cases, is targeted to Your interests, such as information about Service/functionalities offerings that We believe You may be interested in learning more about. In the event of an intellectual property claim, we may transfer your contact details with the claimant for contacting You to resolve the infringement claim directly with You. You may choose to stop receiving these email communications from Us by following the “unsubscribe” instructions included in such communications. If a third-party vendor provides such newsletters, You may unsubscribe in accordance with the instructions provided by such third party. If You are having problems unsubscribing, please contact us at [•] (and You will be removed within seven (7) business days. Please note that We will not process any unsubscribe requests submitted as direct replies to any newsletter.

  2. CONFIDENTIALITY OF YOUR LOGIN ID AND PASSWORD : You are responsible for maintaining the security of Your login ID and Password / OTP and must not provide these credentials to any third party.
