Fiducia Score  Pvt Ltd (in this policy, “we” or “Fiducia Score” or “Fiducia”) complies with the Information Technology Act, 2000, Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 and all other rules, circular and notifications issued thereunder (hereinafter referred to as the ‘Indian Data Protection Law’).

Definitions

Personal Data – any information relating to an identified or identifiable natural person.
Processing – any operation or set of operations which is performed on Personal Data or on sets of Personal Data.
Data subject – a natural person whose Personal Data is being Processed.
Child – a natural person under 16 years of age.

Fiducia Score Private Limited provides its SAAS Platform to companies/clients. We are custodians of the data provided by clients and not the owners of it.

Data Subject’s rights

The Data Subject has the following rights:

  1. Right to information – meaning you have to right to know whether your Personal Data is being processed; what data is gathered, from where it is obtained and why and by whom it is processed. We provide this information to the requesting company whose duty it is to reveal such information to you in turn. You giving authorization for your background to be checked to third party or a company for the purposes of employment, borrowing, etc is the only time the data is revealed. Under no other circumstance is this revealed to anyone.
  2. Right to access – meaning you have the right to access the data collected from/about you. This includes your right to request and obtain a copy of your Personal Data gathered. Since Fiducia Score Private Limited is merely a custodian of the data, such requests have to be routed via the client companies or the authorized third parties. What information that is shown while end users log in, is available for the user to see and only them to see. This may or may not be a comprehensive list of information that client companies may have stored in the SAAS Platform.
  3. Right to rectification – meaning you have the right to request rectification or erasure of your Personal Data that is inaccurate or incomplete provided Fiducia Score Private Limited is source of such information else the request has to be made to the relevant authority example credit score or employment record which is provided by employer etc.
  4. Right to erasure – meaning in certain circumstances you can request for your Personal Data to be erased from our records provided Fiducia Score is the owner of such data.
  5. Right to restrict processing – meaning where certain conditions apply, you have the right to restrict the Processing of your Personal Data.
  6. Right to object to processing – meaning in certain cases you have the right to object to Processing of your Personal Data.
  7. Right to object to automated Processing – meaning you have the right to object to automated Processing, including profiling; and not to be subject to a decision based solely on automated Processing. This right you can exercise whenever there is an outcome of the profiling that produces legal effects concerning or significantly affecting you.
  8. Right to data portability – you have the right to obtain your Personal Data in a machine-readable format or if it is feasible, as a direct transfer from one Processor to another provided the data owner gives the authorization.
  9. Right to lodge a complaint – in the event that we refuse your request under the Rights of Access, we will provide you with a reason as to why. If you are not satisfied with the way your request has been handled please contact us.
  10. Right for the help of supervisory authority – meaning you have the right for the help of a supervisory authority and the right for other legal remedies such as claiming damages.
  11. Right to withdraw consent – you have the right withdraw any given consent for Processing of your Personal Data by disapproving /withdrawing any background check to be done on you to any company which asks for it thus withdrawing consent

Data we gather

There is no data we gather on you without an explicit authorization from our clients/companies who either store such data in our SAAS Platform or have requested it as a background verification service. The data we so gather is stored till such time the company requests its removal from our platform.

Information you have provided us with
This might be your e-mail address, name, billing address, home address etc – mainly information that is necessary for delivering you a product/service or to enhance your customer experience with us. We save the information you provide us with in order for you to comment or perform other activities on the website. This information includes, for example, your name and e-mail address.

 Information automatically collected about you
This includes information that is automatically stored by cookies and other session tools. For example, your shopping cart information for BGV service, your IP address, your shopping history (if there is any) etc. This information is used to improve your customer experience. When you use our services or look at the contents of our website, your activities may be logged.

Information from our partners
We gather information from our trusted partners with confirmation that they have legal grounds to share that information with us. This is either information you have provided them directly with or that they have gathered about you on other legal grounds.

Publicly available information
We might gather information about you that is publicly available.

Types of Personal Information Collected When Performing Background Verification for Clients

As part of its services, Fiducia Score receives information about individuals for the purposes of conducting checks. 

Purpose of Collection and usage

Fiducia Score India collects Personal Information that is relevant for the purpose(s) for which it is to be used, consistent with the Indian Data Protection Law. We process Personal Information in ways that are compatible with the purpose(s) for which it has been collected.

When engaged by a Client for Background Verification, Fiducia Score verifies an individual’s information, documentation and any responses by carrying out verification checks for the purposes of preparing an employment, investigative, or due diligence report. This is done at the Client’s request to enable them to assess an individual’s suitability for employment, promotion, provision of services, or other purposes in accordance with their legal obligations and internal risk management policy (including but not limited to insurance and claims review). 

In certain circumstances, Fiducia Score may be engaged by a Client to prepare an employment or investigative report because they are required by law to determine a candidate’s suitability for a position of employment. 

Fiducia Score may use the Personal Information, documentation and any responses an individual or third party reference has provided to us to apply to various other entities (“Sources”) for verification of an individual’s personal and other information, to collect additional Personal Information, and to conduct public record searches. Examples of Sources include, but are not limited to, government agencies, law enforcement bodies, publicly available records, public registries, court or tribunal records, educational institutions, current and/or previous employers, and regulatory and licensing bodies. 

Fiducia Score will then use the Personal Information to prepare a report outlining the findings of its investigations and provide the report to the Client via a secure means. The Client may then use that information to consider an individual’s suitability for employment, change in the level of responsibility, or other circumstances where an individual’s background is relevant, or to determine if further verification or investigation is necessary.

We do not use the PII which we receive from the candidate for any marketing and advertising purpose. Any data used for statistical purposes will be anonymised.

Disclosure of Information Collected

When engaged for background verification, Fiducia Score may disclose Personal Information to clients and third parties acting as agents to complete a check requested. Such disclosure may be necessary for processing purposes to complete the check and will be only for limited and specified purposes.

Fiducia Score will disclose information only with when the individual provides “AADHAR CARD NUMBER” which acts as a password to for any company to check the data.

Fiducia Score may disclose Personal Information to overseas recipients. The circumstances of disclosure may be as follows: 

Where required by law, Fiducia Score may, without consent of the provider, disclose Personal Information to external law enforcement bodies or regulatory authorities, in order to comply with legal obligations.

Once we receive Personal Information, we take steps to protect its security on our systems. In the event we request or transmit Sensitive Information, we use industry standard, secure socket layer (SSL) encryption. Our Data is stored in Amazon Web Services in India and is regularly audited to ensure that the security controls are effective and in place.
